I think we must be realistic. Under the old ADA, passed in 1990, no courts held that the ADA covers stuttering. The new ADA, which took effect in January of 2009, lowered the bar on what can be considered a disability, but stutterers have continued to lose ADA cases. One court in the Eastern District of Pennsylvania, in an unreported decision in 2011, found that the ADA did cover the stutterer in question. But other courts have continued to find otherwise. In the BESS case in the Eastern District of North Carolina, also decided in 2011, the Plaintiff alleged that it was his understanding that the ADA covers stuttering. The Court said that it could not agree with this conclusory statement and found against him.
